Terms of Service

Watch It? Track It. (the "site") is operated by Scott Zsori ("we", "us"). These terms cover the website, its accounts, and the data it publishes, including the public API. By using any of them, you agree to these terms. If you don't agree, please don't use them.

Accounts

You must be at least 13 years old, or older where your local law requires, to create an account. Give accurate information, keep your password to yourself, and tell us if you think someone else is using your account. You're responsible for what happens under your account.

Your contributions

You can add and edit records, names, descriptions, images, credits and other information ("contributions"). When you post a contribution, you confirm that you own it, have permission to post it, or that your use of it is allowed under copyright law, including fair use. You keep any rights you have in your contributions, and you give us a worldwide, royalty-free, perpetual, irrevocable license to host, store, copy, adapt, publish and distribute them, including to third parties through the public API, and to let others do the same.

Responsibility for content

Contributions come from users and from other sources, and we don't review them before they're published. We assume no responsibility for content posted by users or taken from third parties, and we don't endorse it. We may edit, hide or remove any content, and restrict any account, at any time and without notice.

Acceptable use

Don't post anything unlawful, infringing, hateful, harassing, sexually explicit or misleading. Don't impersonate others, attack or overload the site, get around its security, or scrape the website's pages: use the public API instead. Don't use the site to send spam or malware.

The public API and data

The data the site publishes is available as static files, described in the API documentation. Non-commercial projects and startups may use it for free. Profitable commercial projects need a paid license: $100 per month for companies with a net worth up to $1M, and $1,000 per month above that. To arrange one, contact scott@watchittrackit.com. The data is provided as it is, may be incomplete or wrong, and may change or stop being available.

Payments

Paid plans and licenses are billed in advance for each period and renew until cancelled. Except where the law requires otherwise, payments aren't refundable.

Copyright complaints

If you believe something on the site infringes your copyright, follow the process on our Copyright page. We remove infringing material and close the accounts of repeat infringers.

Other sites

The site links to other websites and services. We don't control them and aren't responsible for their content or practices.

Disclaimer

The site, its content and the API are provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose and non-infringement. We don't promise that the site will be uninterrupted, secure or error-free.

Limitation of liability

To the extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the site or the API. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim and $100.

Indemnity

You agree to cover us against claims, losses and costs (including reasonable legal fees) that come from your contributions, your use of the site or the API, or your breaking these terms.

Ending your use

You can stop using the site and ask us to delete your account at any time. We may suspend or end your access if you break these terms or if we need to for legal or security reasons. The sections on contributions, responsibility, disclaimer, liability and indemnity continue to apply afterwards.

Changes

We may update these terms. The date at the top shows when they last changed. If you keep using the site after a change, the updated terms apply.

Governing law

These terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Minnesota, and you agree to their jurisdiction, unless the law where you live gives you the right to bring a claim in your own courts.

General

These terms are the whole agreement between you and us about the site. If a part of them can't be enforced, the rest still applies. Not enforcing a part isn't a waiver of it. You may not transfer these terms; we may.
